GENERAL BOOKING CONDITIONS

Information prior to the contractual process

1. Contracting Conditions and Legal Framework

These General Contracting Conditions (hereinafter General Conditions) shall regulate the commercial relationship arising between SUBIBOR SL, (hereinafter PROTUR HOTELS), whose fiscal details appear at the end of the text, and the user or client through the contracting carried out via the forms that Protur Hotels makes available on its website https://protur-hotels.com.

Booking through Protur Hotels' websites implies the express acceptance, by the client or user of the pages, of these conditions, as well as the conditions of use established for the user's navigation through the pages owned by Protur Hotels. These conditions shall apply without prejudice to the application of the legal regulations on the matter that are applicable for each case.

These General Conditions are subject to the provisions of Law 7/1998, of 13 April, on General Contracting Conditions, Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, Law 3/2014, of 27 March, modifying the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights, Law 7/1996, of 15 January on Retail Trade Regulation, Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce and Law 18/2012 of 19 July, on Tourism of the Balearic Islands and any other applicable legal provisions.

Protur Hotels reserves the right to make such modifications as it deems appropriate, without prior notice, to the General Conditions. Said modifications may be made, through its websites, by any legally admissible form and shall be binding during the time they are published on the web and until they are validly modified by subsequent ones. However, Protur Hotels reserves the right to apply, in certain cases, Particular Contracting Conditions in preference to these General Conditions when it deems appropriate, announcing them in due time and form.

2. Prior Information and Booking Process

Protur Hotels informs that the booking procedure through its web pages is detailed in the section named Bookings.

Likewise, Protur Hotels informs that the user can access the conditions of use by clicking on the Legal Notice section.

Once the booking is made, the user will see the confirmation of their booking on screen, being able to print this as proof of the booking made.

The booking confirmation and the booking receipt (printout made by the user) shall not be valid as an invoice.

By booking with Protur Hotels through its website, the user or client expressly declares to know, understand and accept said conditions of use and general booking conditions. Similarly, the user declares to be of legal age and have the necessary legal capacity to access Protur Hotels' websites and contract through them. The user is responsible for treating the identity and password obtained in the registration as a client confidentially and responsibly, not being able to transfer them to another.

⏱️ Stay Times:

  • Rooms may be used from 14:00 hours on the day of arrival.
  • They must be vacated before 12:00* hours on the day of departure. (* at 11:00h in the case of Protur Atalaya Apartamentos and Protur Naisa Palma Hotel).
  • The booking will be guaranteed until 18:00 hours on the day of arrival. If you foresee arriving at different times, it would be advisable to communicate this as far in advance as possible.

3. Booking Operation, Prices and Discounts

Booking offer and price reference.

Offers will be valid solely during the period fixed and the conditions set out by Protur Hotels in the advertisement, or failing that, during the time they are accessible to clients for effective contracting. Protur Hotels reserves the right to check compliance with the conditions to be able to apply the offer.

Indication of prices.

Each possible booking offered will indicate its price in euros and whether it includes VAT or any other tax that, where applicable, is applicable. The prices indicated on screen will be those valid at any given time barring typographical error. When the price is different for the reason stated above, Protur Hotels will communicate this to the client, via e-mail, before proceeding to charge the booking.

As a general rule, the booking price includes exclusively: accommodation, half board accommodation, all-inclusive accommodation or bed and breakfast. The availability and price of requests for special services such as: need for a cot, extra bed, etc. that could not be included in the online booking calculation, will remain pending confirmation by the hotel, confirmation which will be made in writing to the client.

Age Discounts

Must be accredited via ID card, passport or family book. Discounts always applied with two adults in the room.

  • Children: 0-6 FREE
  • Children: 7-12 50% disc.
  • *In Aparthotels children are aged 7-14 years.

The total and final calculation of the booking includes VAT or IGIC, unless not expressly included. Any other rate or tax affecting its final price will be settled additionally at the hotel establishment. The receipt is valid solely for the dates, persons and amounts specified. (It is important that all minors, even those who are free of charge, appear on the booking confirmation).

4. Availability, Payment Methods, Cancellations and Booking Modifications

Availability

The availability of the offers offered by Protur Hotels through its web pages may vary depending on client demand. Although Protur Hotels updates the database periodically, the booking requested by the client could be full at that time. In such a case, Protur Hotels will send an e-mail to the client informing them of the impossibility of the offer's availability.

Payment methods (booking).

Payment at the hotel, a credit card will be required as a booking guarantee. You have other payment options with deposit, bank card, Paypal or bank transfer where 10% will be paid. In the bank transfer payment option, bank charges are borne by the client. The remaining percentage must be paid at the time of check-in at the hotel. (Except bookings with special conditions). Payment of the remaining amount may be made by bank transfer or card (always via form/authorisation sent by email). The payment of the remaining amount may be split into a maximum of 3 payments with a minimum amount of 600 EUR per payment.

Only bookings made 10 days or more before the arrival date may opt for payment by transfer. If the transfer does not arrive within a period of 5 working days from the booking date, Protur Hotels reserves the right to automatically proceed to cancel it.

Bookings with special conditions or Non-Refundable rates. Advance payment of 100% of the amount. Modifications are not accepted, and in case of cancellation, the amount will not be refunded under any circumstances.

All payments made to Protur Hotels involve the issuance of an invoice in the name of the

Client or the company name that was informed at the time of making the booking.

Booking Cancellation

Cancellation of the booking. The booking made may be cancelled via email to info@proturhotels.com always indicating the booking code.

If you cancel the booking before 12:00h on the day prior to the arrival date, the establishment will NOT make charges. If you cancel the booking after the deadline, or in case of no-show, the establishment will charge 100% of the first night, for administrative management.

Bank charges generated by booking cancellations will be borne by the client. In any case, the corresponding invoice will be sent to the address stated by the client upon registration.

Bookings with special conditions or Non-Refundable rates. Advance payment of 100% of the amount. Modifications are not accepted, and in case of cancellation, the amount will not be refunded under any circumstances.

Booking Modification

Modification of the booking. The booking made may be modified, at a later time, via email to info@proturhotels.com, always indicating the booking code. The success of the modification will depend on the availability of Protur Hotels at the time of the request.

The modification of the booking will be subject to hotel availability, applying the price and conditions valid at the time on the date of the modification request.

The second and subsequent modifications of the booking made by the client will involve an outlay of €6 due to administrative management expenses.

Bookings with special conditions or Non-Refundable rates. Advance payment of 100% of the amount. Modifications are not accepted, and in case of cancellation, the amount will not be refunded under any circumstances.

Exceptional modifications of Non-Refundable rate or Semi-non-refundable Rate: Exceptional modifications will entail a penalty, which will vary depending on the dates and conditions. No refunds or compensations will be made in case of prices lower than the initial booking.

UNFORESEEN DEPARTURE

When an unforeseen departure occurs before the end of the contracted stay, if the departure occurs after 11:00h, the Hotel will additionally invoice one night in the contracted regime (as penalty and cancellation fees), being able to proceed to the refund of the remaining unused nights, provided that a flexible rate is available. To make the refund, the client must contact the booking centre at the email: info@proturhotels.com so that the possible refund can be managed.

6. Balearic Tourist Tax (Law 2/2016)

We inform you that the Balearic Parliament has established a new tax levied on stays in any tourist establishment in the Balearics since 1 July 2016 (Law 2/2016, on the Tax on Tourist Stays in the Balearic Islands).

The tax amounts to between €4 and €1 for each day of stay or fraction thereof, plus 10% VAT. The applicable rate depends on the type of tourist establishment, as well as its category.

A 75% discount applies for stays in low season (from 1 November to 30 April of the following year), as well as another 50% discount for the 9th and subsequent days of the same stay. Likewise, guests under 16 years of age are exempt from paying the tax.

Therefore, any natural person (aged at least 16) staying in a tourist establishment in the Balearics is obliged to pay said tax by paying it to the owner of the tourist establishment where they are staying.

Consequently, and in our capacity as those obliged to settle said tax before the Balearic Tax Authorities, we inform you that, in compliance with current regulations, before the end of your stay at our establishment, we will proceed to request payment of said tax.

The collection of the tax will feed a Fund for the promotion of sustainable tourism whose purpose will be the financing of projects that contribute to the promotion of sustainable, responsible, and quality tourism, specifically, for the protection of the natural, rural, agrarian, and marine environment, the promotion of seasonality adjustment, historical and cultural heritage, R&D&I, training, and employment. Said projects will be selected by a Commission for the Promotion of Sustainable Tourism.

8. GIFT VOUCHERS

The price of our products is reflected in euros and with VAT included.

Together with the product price, shipping costs may apply which will be published on the web and at the time of purchase. IMPORTANT: currently no shipments are made to the Canary Islands, Ceuta, and Melilla. The delivery time is 8 days for Peninsula and Balearics. Please note, delivery times are an estimate and are subject to some delays during periods of high activity.

We accept the following forms of payment:

  • Credit card: Visa and Mastercard
  • Debit card: Visa Electron, Servired and Maestro
  • Paypal

Recipients of certain gift vouchers may be required to meet a series of personal conditions such as age, health status, etc... These conditions may be consulted in the product description or by contacting the activity provider.

If you arrive late for the activity reserved with the gift voucher, it may reduce the activity time or cancel the appointment implying the loss of the gift voucher.

In case of making use of any service offered by the accommodation and not included in the voucher, this shall be paid for at the accommodation itself.

Once the voucher purchase is made, in no case will the amount corresponding to the voucher purchase be refunded.

The reservation of the date for the enjoyment of the gift voucher must be made at least 48h in advance.

Once the reservation is made, cancellations will not be admitted. It may only be changed if it does not entail any detriment to Protur hotels.

Vouchers will be valid until the expiry date expressed on the voucher. It shall not be extendable. Non-use of this voucher does not give rise to a right to refund.

The same accommodation may be in different vouchers with different premises, whether due to the typology or different pricing of its rooms or apartments. Protur hotels undertakes to reserve the corresponding premise in each voucher.

Voucher subject to availability. It is necessary to present and hand over the voucher upon arrival at the establishment. It is essential to always identify at the time of booking that you have this voucher and indicate its number.

Protur hotels reserves the right to modify rates without prior notice, guaranteeing the price paid at the time of purchase.

In the case of accommodation gift vouchers, the price of this product does not include the tourist tax of hotel establishments in the Balearic Islands, applicable according to Law 2/2016, whose amount will vary depending on the hotel category. Said tax + VAT must be directly paid by the client at the hotel reception upon arrival.

8. Client Rights and Duties

Client rights:

  • All information provided to the client shall be binding for the offeror in the terms established by consumer protection legislation. 
  • Every user of tourist services has the right to ensure that the goods and services acquired are of the contracted category and legal requirements or of that quality which bears direct proportion to the category of the tourist establishment. 
  • All establishments are obliged to have a complaint book available to the client where they can record their complaints. To formulate a complaint, request these sheets, fill in with your personal data and clearly indicate the reason for the complaint. 
  • The user has the right to use the withdrawal form, according to the conditions of Royal Decree 1/2007 of the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws.

Client duties:

In the enjoyment of the contracted tourist services, every user has the following obligations:

  • Pay the price of the contracted services, without the presentation of a complaint or claim exempting them from this obligation. 
  • Comply with the particular rules of the hotel establishment whose services they enjoy.
  • Observe the rules of hygiene, education, and good customs towards the rest of the users and the staff of the hotel establishment providing their service.
  •  Respect the environment.

9. Data Protection and Jurisdiction

Data Protection (GDPR)

In accordance with current regulations on Personal Data Protection, we inform you that your data will be incorporated into the processing system owned by Subibor, S.L, with CIF B79214995, located at AVENIDA BELLA VISTA 2 07560, CALA MILLOR (BALEARIC ISLANDS), for the purpose of attending to your enquiries, sending you related information that may be of interest to you and attending to your bookings and services contracted through our Webs. 

In compliance with current regulations, PROTUR HOTELS informs that data will be kept for the strictly necessary period to comply with the previously mentioned precepts. Unless you communicate otherwise, we will understand that your data have not been modified, that you undertake to notify us of any variation and that we have your consent to use them for the mentioned purposes.

PROTUR HOTELS informs that it will proceed to treat the data in a lawful, fair, transparent, adequate, relevant, limited, accurate and updated manner. That is why Subibor undertakes to adopt all reasonable measures so that these are deleted or rectified without delay when they are inaccurate. In accordance with the rights conferred by current data protection regulations, you may exercise the rights of access, rectification, limitation of processing, deletion, portability and opposition to the processing of your personal data, as well as the consent given for the processing thereof, directing your request to the postal address indicated above or to the email address dpo@grupbauza.com 

In turn, we inform you that you can contact the Data Protection Officer of PROTUR HOTELS, by writing to the email address dpo@grupbauza.com  

Purpose of processing: economic and accounting management, tax management, administrative management, billing management, client and supplier management, collections, payments and related services management, commercial relationship history, video surveillance of facilities, maintenance of commercial relationships, management of traveller check-in registration in accordance with Organic Law 4/2015, of 30 March. Express information is given regarding the use of passport scanning for payment control and guest activities, for the purpose of avoiding misuse of charges to the guest's name or room. Express information is given regarding the purpose of using Wifi systems, which allow the collection, use and processing of your personal information, to manage your purchases, requests, improve the guest experience, create personalised offers and meet legal connection monitoring requirements. Managing registration for complementary offers developed by Grup Bauzá, such as contests, raffles, promotional activities and others that may be organised. 

 For compliance with legal obligations, including providing traveller information to competent authorities, in affected bookings, in compliance with Royal Decree 933/2021 on traveller registration, with legitimation in art. 6.1 c) of GDPR 2016/679, detailing operations regarding complete data of clients and guests, complete transaction data as well as those expressly detailed in the Law is necessary. 

You may address the competent Control Authority to present the claim you deem appropriate.

Jurisdiction

Protur Hotels also reserves the right to file civil or criminal actions it deems appropriate for the misuse of its website and content.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Protur Hotels has its domicile in BALEARIC ISLANDS, Spain. Should any controversy arise, the parties may submit their conflicts to arbitration or go to ordinary jurisdiction.
